This paper aims to present the motivations of a group of international students enrolled in the English division of the Faculty of General Medicine, at Ovidius University of Constanta, who intend to pursue medical training in Romania, to return to the country of origin after obtaining the medical degree or to go elsewhere for the medical specialty or to practice medicine. The main objective is to study the motivational process of this student population in the context of long-term academic international migration and temporary migration to Romania in order to determine the role it plays in the 21st century University, which represents one of the actors in the knowledge economy. To do this, we use oral data collected through semi-structured interviews which will be subjected to qualitative and quantitative content analysis. The conclusions of this article will highlight the importance of the presence of international students in Romanian universities and the knowledge of their motivations in the context in which among their challenges are an increased attractiveness and visibility at an international level. This study can be important for other researchers interested in sociolinguistics, in international student migration for studies and in the study of language pathways and motivational factors and can offer a useful tool for all actors involved in the reception and the training of this category of students. Subnational government inequalities are always a challenge for the countries all over the world, in particular large ones, even are unitary states or federations. Romania has a unitary system, but decentralization process and different level of economic development of individual territorial units determine specific problems resulting in fiscal gaps, both horizontal and vertical. The paper focuses in the first part on the review of the literature regarding the measurement of the vertical and horizontal fiscal imbalances, and the second part will measure fiscal imbalances in Romania counties based on methodologies identified in the first part. Despite being a unitary country, Romania presents an increasing of horizontal fiscal imbalance and high vertical fiscal imbalances for 28 counties of 42. Motivated by the lack of this incrimination in the 1969 Criminal Code, in this paper we have proceeded in examining the offense of evading removal measures in the country. In the paper we have considered the examination of the pre-existing elements of the offense, of its constitutive content, as well as of the legislative precedents. We also considered the examination of the similarities and differences between the two texts, which are absolutely necessary in the application of the more favorable criminal law in transitory situations. The novelties concern both the examination of the constitutive content of the offense and the comparative examination of the two crimes. In the paper entitled "Risks and vulnerabilities generated by gambling addiction", we have described the risks and vulnerabilities that gambling addiction generates on MIA missions and on the classified information handled. The scientific approach is based on the premise of the security awareness in which we must recognize the importance of the checks carried out by the intelligence services in the process of granting access to classified information, as well as their contribution to national security. However, the gambling phenomenon has grown in Romania, a situation in which it could have a negative impact in the circumstances of a possible addiction, including among MIA's personnel. The study of our topic aims to identify European legislation, with applications in national law, where Romanian norms allow such similarity. Of course, it is interesting to note the extent to which damage is caused by an entity with artificial intelligence and the manner in which it may be held liable from a civil point of view. The basis of this research are the norms in force in Romania and those within the European Union. The method used is mainly the analysis of existing documents in the European Union. What we have in mind is an improvement of the existing legislative framework, but also an interpretation of the rules at the level of the European Union. This paper can be an interesting read for law scholars, from university professors, lawyers, magistrates and other jurists to students, as it presents a current issue that may not be sufficiently developed in contemporary society. The article is not so much an exhaustive work as a compendium that summarizes the laws and situations in practice, with applicability in the matter of civil liability, in case of damage caused by autonomous means of transport. This paper aims at making a brief analysis of the relevant EU legal acts in matters of international judicial and police cooperation and the effects on the national legislation of Romania. The objective is important as it concerns the European area of freedom, security and justice, protecting citizens being a fundamental objective of the Union. The paper will consider the terms and concepts mostly legal and will focus on the areas of international police and judicial cooperation. The approach used by the authors is, in essence, from a legal perspective, being used research methods like study and observation. The result of research leads to the conclusion that international judicial cooperation in criminal matters is complex, requiring the transposition into national law of a larger number of EU legal acts compared to international police cooperation. The paper may have implications in the activity of institutions which have attributions in the fields above-mentioned, but can be useful for people interested in the evolution of internal legal documents. Essentially, the work highlights the need for giving up legal national pride for the best possible cooperation of the member States authorities with responsibilities in both areas. Our paper is a review of the "Junk" program in Romania after more than 10 years of implementation. It discusses the limitation of the program individually and of the environmental policy as a whole in our country. We also intend to talk about the main limitation of the research area and the shortages in public information. This paper addresses the grey legal area of moral harassment at work under the Romanian legislation, with a focus on employer responsibilities deriving from claims grounded on such discrimination deed. It puts under spot light an issue that Romanian employers confront with on a daily basis and which has not been analysed and conceptualized up to the present. The author has relied on previous research she conducted with respect to moral harassment at work, with the aim to build legislative propositions to be further considered during the legislative process. The research outlines the currently applicable legal framework in Romania, as well as the status quo of the files submitted with the courts of law addressing moral harassment at work. The paper synthetises the conclusions of the observations made throughout the last 4 years in practice (court procedure). This paper highlights that, despite the efforts undertaken by the Romanian legislator in order to ensure protection of employees at work, the concept of "moral harassment at work" does not benefit from any regulation under the Romanian legislation. As a paradox, there is an outstanding number of court files initiated by (former) employees against their employers, grounded on mobbing, that usually go through the two-stage trial procedure (first phase of judgement and appeal), thus determining the courts of law to frame the concept of moral harassment at work based on related legal concepts (discrimination, harassment, psychological harassment). The study has implications for researchers, employees and employers, students and academics. The present paper reviews good practices in modern management and marketing for sports clubs, especially in the Martial Arts. Objectives: to study how modern management and especially marketing should impact the development of martial arts clubs in Romania, by comparison to good practices identified in the USA. Prior Work: most available data is from USA, and relevant literature has been thoroughly reviewed, with an emphasis on modern marketing practices; Approach: for the purpose of clearly identifying marketing and management influence, a survey has been submitted to all known martial arts clubs registered in Romania; Results: survey results highlight the importance of modern marketing in attracting new practitioners, while modern management should make the sports activity lucrative and profitable; Implications: present findings and their interpretation are meant to provide academics and researchers with a foundation for further studies, as well as to send a signal to the policy-makers in charge; Value: according to our knowledge, this is the first study on this subject in Romania, and its' importance is relevant as a significant part of the health system and policies. The pandemic crisis has affected the unemployment of the entire world between 2019 and 2020 and, in particularly, in Romania and Republic of Moldova. The aim of the paper is to analyze the impact that the Covid-19 crisis has influenced the employment and the rate of unemployment in 2020 compared to 2019 in the two neighboring countries that have certain similarities, but also differences in terms of the labor market. The economic activity was strongly influenced by the lockdowns imposed by the governments of the two countries, so that in many fields of activity lots of companies went bankrupt, which led to an increase of the unemployment rate in 2020, compared to the previous year. The initiatives of social entrepreneurship are rather scant in Romania, social businesses scoring a significant increase during the last ten to six years, with such enterprises as Ashoka Romania, Meşteshukar ButiQ, Atelierul Merci, MamaPan, Concordia Bakery, etc., being especially active in this field. Nonetheless, this particular environment remains problematic, in the absence of public policies encouraging this new type of business and the general redistribution of profit. This paper is concerned with the definition and conceptualization of the notion of "social entrepreneurship", providing a theoretical and taxonomical framework for the discussion of social business in Romania. Furthermore, it dwells on three case studies in Romania, in the attempt to properly identify the steps in the process of initiating a social enterprise and the main challenges this type of endeavor is currently facing in the Romanian context, during the last six years, in a -- what would seem -- increasingly welcoming entrepreneurial environment. The liberal profession plays an important role in creating added value and profitability in the current economy context of Romania, especially in this time of global health crisis. In this regard, it is safe to assume that, in 2021, the liberal professions in order to remain viable will need an independent advice and support because of the constant expansion of national legal standards. Moreover, in view of this sector's growth potential and the proportion of jobs that it provides, the entrepreneurial aspect of the liberal professions must be acknowledged and supported, since the services provided by liberal professionals are complex and require a high level of expertise. In the light of the Decisions no. 51 of 16-th of February 2016, respectively no. 26 of 16-th of January 2019 of the Constitutional Court of Romania, the national courts were invested with researching the manner in which the technical surveillance mandates were executed. Specifically, the defenders of the persons whose conversations were recorded requested to verify whether the technical surveillance mandates were executed by a competent authority. Nationwide, there was outlined a practice of the National Anticorruption Directorate to answer the questions addressed by the courts in the sense of specifying whether the Romanian Intelligence Service provided a simple technical support in the criminal investigation activity, without carrying out criminal investigation acts. The defense of the National Anticorruption Directorate was based on the fact that the technical support does not concretely imply a criminal investigation activity, aspect that was also held by the Constitutional Court of Romania by its Decision no. 26 of 16-th of January 2019, paragraph no. 155. The notion of "technical support" is a very vague one, being necessary a distinction between the simple provision of logistic support in order to execute the technical surveillance mandate by the competent body and the support of the Romanian Intelligence Service agents in the stage of obtaining evidence through the evidentiary procedure of interception and recording of telephone calls/ conversations. This paper aims to highlight, by means of examples from the national judicial practice, the cases in which the "technical support" provided by the Romanian Intelligence Service acquires the valence of a procedural act that must be sanctioned with absolute nullity. In Romania, a new management of the public administration structures is required for the efficiency of the available financial resources. The main objective of this paper is the management of financial resources, both from public own funds and from non-reimbursable funds from the European Union. The working method used is the analysis of the way in which the funds received by the territorial administrative units from the South-East Region of Romania contributed to the modernization of the public administration. The paper analyzes the institution of the recognition and enforcement of foreign judgment, in the case where a convicted person is in Romania, as well as some references to the conditions of Romanian law to be fulfilled in order to have the recognition and enforcement of such a judgment. Also, according to our research it results that the Romanian legislator has not provided the mandatory legal assistance to the person concerned, which is why we have made proposals de lege ferenda. The paper may be useful to practitioners in this field, and academics. The innovations consist in examining the institution of the recognition and enforcement of foreign judgment, in the case where a convicted person is in Romania, with the new amendments to the Romanian special law and the wording of the proposals of de lege ferenda. Objectives: Public imbalances can cause extensive problems both on public finances and economy. Regardless of the constitution and destination of funds it is absolutely necessary to verify their correct accounting, collection type and expense in accordance with applicable regulations, and if due attention is paid to obtain an optimal balance between resources and results. Therefore it is useful to study the role of public audit in the formation and use of public funds to indicate its impact on the budget balance. Prior Work: This paper presents the evolution of synthetic budgetary indicators during 2010 - 2013 and the impact that the external public audit had on the budget deficit. Approach: In order to highlight the importance and necessity of public audit activity it has been analyzed its influence in the formation and use of public funds and the extent of implementation of the recommendations made in the audit reports. Results: In the study conducted we have set out several conclusions regarding definite reality according to which financial resources materialize a large part of GDP, so that advocates for public performance of the audit. Implications: The need for public audit can be viewed through the prism of the three classes of economic and financial interests, namely: the interests of public entities, third party interests of consumers of public goods and services and state interests. The new Criminal Code adopted by Law no. 286/2009, which entered into force on 01.02.2014, introduce regulation supporting causes and causes of non - imputability, unlike the Criminal Code of 1969, as a natural result of the changes the concept offense (art. 15 NCP). Implications knowledge of this concept, which characterizes the essential features of great importance for the activity of judicial enforcement of criminal law, criminal law and for recipients who are subject to its knowledge. This paper presents an analysis of newly introduced institutions Romanian criminal law, revealing the foundation concepts, the innovations and their justification based on legislative experience, doctrine and jurisprudence of other states, and the Romanian state. Result of these experiences is introduced into Romanian Criminal Code provisions designed to achieve a settlement of the concept of crime, its content, in agreement with the appropriate vision on offense. Study of the causes of justification and causes of non-imputability, based on analysis of the legal texts and authors analysis presents possible implications, the entry into force of these provisions. Within the paper it is examined the constitutive content of the offense on leaving post and the presence to work under the influence of alcohol or other substances according to the new criminal code entered into force on 01.02.2014. The novelty consists in the examination performed in the light of the new amendments and completions to the law, and the comparative analysis with the old law, considering the transitional situations involving the more favorable application of the criminal law. Within this paper we resume a topic widely debated in the specialized literature and always topical, by the implications that it has on the development of public administration and satisfying the general interests. This paper is designed as a comparative study between Romania and Turkey on certain aspects of local electronic government elements of several localities of those 2 countries. The differences between the countries considered in this study are not neglected, starting with culture (organizational, but not only) and ending with economic aspects. In the paper we will present: the IT framework in which public administration operates (with features on each country); macroeconomic issues with direct impact on the development of egovernment - where we present financial information on investments in IT sector in both countries; and the municipal web sites analysis of the countries - were we try to find, using a predefined scale, common elements and differences that arise when we look at the development of the local e-government. Objectives: We will find out why Internet users in Turkey visit and interact more frequently with the Local Administration Web Site than those in Romania. The intention is to build the architecture of a Web site designed to provide good interaction to citizens. Approach: This paper is an in-depth analysis of official web sites of town halls. We used a predefined scale taken from similar studies, but adapted to extract relevant elements. For a more accurate study we compared cities were the difference (in terms of finance and inhabitants) is not too big. Results: As a result we will find out why Internet users in Turkey visit and interact more frequently with the Local Administration Web Site than those in Romania. This article is a study focusing on an important area of appliances we inevitably use almost daily and which has a tendency of renewal, diversification and quality improvement - that is the television set. There is a discrepancy between the quality of the products on the market and the one required by customers. When the difference between them is minor, it has a stimulating role for the producer, but when it is considerable, there is a negative effect on the customer. Thus, this paper carries out a comparative analysis of quality on a segment of television sets traded in Romania which represents a main component of enterprise management by means of which decisions on quality strategy according to market variations are made. The present analysis aims to highlight the different methods of verification of the data obtained by judicial bodies through technical surveillance methods provided by the Criminal Procedure Code. Although the current legislative framework as interpreted by the Constitutional Court of Romania provides specific guarantees in order to prevent using forged evidences in the criminal trial, we believe that the court, after the indictment, needs to verify on its own the authenticity of such means of evidence. Therefore, the doctrine and the recent jurisprudence of national courts stated in this context the need for an independent expertise that can analyze the data obtained through technical surveillance in order to be used as evidence in a criminal trial. Also, the present context of the Romania legislative reform and the context in which several cooperation protocol between criminal investigation bodies and Romanian Intelligence Service were declassified, led to a stringent need for such an expertise. We tend to believe that without an independent expert that can assess whether the recordings are authentic or not, the court cannot in good faith decide to convict a person. The present paper aims to analyze the judicial expertise of devices that contain the results of the technical surveillance activity from a procedural point of view. The constant evolution of technical methods to obtain evidences in criminal trials led to the development of new types of expertise in various fields. One of these is the expertise of any device or optical support on which recordings of intercepted conversations are stored. Statistical data from the courts shows that technical surveillance is very common in Romania, being used as proof for various crimes from white collar crimes such as abuse of office or bribery to violent crimes or drug trafficking. Yet, being electronic the recordings can be forged, fragmented, collated aspect that can lead to unlawful trials or abuses from judicial bodies.In order to prevent that, the doctrine and the jurisprudence stated that the court may order technical expertise of the recordings to verify their the authenticity and continuity. If it is found, after examination, the lack of authenticity of the records or interfering mixes in the text or removal of passages of conversation, they cannot be retained in the case and cannot be used as evidence. Furthermore, judicial expertise of devices that contain the results of the technical surveillance activity can prove to be of real value in different kinds of criminal trials, from corruption cases, to murder trials, drug trafficking, human trafficking, etc. The academic and practical interest of the present study lies in the fact that it addresses both law theorists and practitioners in the field as it analyzes how judicial bodies can use the judicial expertise in the criminal trial and how to corroborate such a report with the other evidences administered by classic methods. Social media era brought a major change in the way politicians communicate online with their voters. Social platforms are bringing politicians closer to people and communication is now more interactive and more personalized. The paper examines how a woman politician, the mayor of Bucharest, the capital city of Romania, uses social media to promote personalized messages in daily political communication during an ordinary period of office. Politicians use personalized communication in the online environment to transmit both personal information about family life, religious orientation, personal experiences, and to disseminate information of public interest that has not been made public by traditional media. This fades the boundary between what is public and what is private. There is a broad agreement on the fact that the personalization of the political message must be studied as a multidimensional phenomenon (Holtz-Bacha et alii, 2014; Nave, N. et alii, 2018) being "a natural consequence of transformations at the level of political and media systems, at the level of society and public culture" (Toader, 2017) transforming politicians into "intimate strangers" (Stainer, 2007). The research analyzes the personalized messages on the Facebook page of Gabriela Firea, the mayor of Bucharest, between 1st of July and 31st December 2018 on quantitative criteria, as well as the reactions of the online public and is part of a larger research work that approaches the triad of women political leadership, social media (Facebook) and political communication from a multidisciplinary perspective. In this paper, we intend to follow how the patriotism was explained to Romanians during the period preceding Romania's entry into the First World War. We consider our approach important and because on 1st of December 2018 the Romanians celebrated for the one hundredth time the Day of the Great Union. In our research, three texts, each of them belonging to another author, will be followed. The first text represents an orthodox Christian point of view on patriotism, the second text comes from the sphere of politics, and the last text on which we will stop embodies the military vision of the matter dealt with here. Among the important changes brought about by the early years of the interwar period in the life of the woman was the fact that she, the woman, was no longer regarded as the "weak" half of man, as it had been before, but the "beautiful" half. Another feature of the interwar era is that beauty is no longer old. The desire of the interwar woman, regardless of her social status or her age, of being always beautiful was explained by the fact that a beautiful woman was easier to find a job or get into the business world. For some journalists, lipstick and last fashion clothes were specific to women of mild morals. Most of the texts used for this paper were published in the years between the two world wars. The petition right, as a fundamental right of the Romanian citizen has the character of juridical warranty because this right is guaranteed by the Constitution and also is a substantive law. By granting the petition right is assuring a good administration of the state in the citizens' favor. The aims and the objectives of the present research is to present the fundamental petition right of the Romanian citizen at the doctrine level and the characteristics of this guarantee right. Regarding the prior work, the analyses conducted so far have dealt less frequently with the topic approached here. The approach used in the present study was to analyze the Romanian constitutional doctrine. The results of the present study are important to the social society because it makes the correlation between the petition right and the good administration. Developing the present research, we took into consideration the importance freedom of speech has. The opportunity an individual has to express his true feelings and thoughts is a matter of the human being's essence and it is considered a natural right. Even so, throughout man's existence, the individual met enclosure in benefiting from his natural freedom of speech way too many times, people being severely punished for their attempts at expressing their true feelings and ideas. The gesture was often considered defiant. In Romania, one's right to free speech ceased to be censored in the post-communism era, fact which induced us the necessity of exposing how one's freedom of speech was perceived and enclosed in the communist era. Another topic addressed in this paper is related to the extent of freedom of expression. If in the past, expressing our opinions lead to an enclosed freedom of speech, nowadays we have the issue of those using this natural right abusively. People often use their freedom of speech without thinking clear, which leads to damaging another individual's rights and personal values, such as their personal dignity, the right to privacy, religion and many more. Romanian education has crossed a period framed after the Revolution of 1989, which had to adapt to the new demands of the market economy. The Romanian education transition had also to be reformed in conditions in which it passed from a strict higher education, limited in numerical terms, to one in which admission has often become a mere formality. The emergence of higher private education was also an element specific to the period. In the desire to adapt, update the legal framework, the Romanian education was most affected by the legislative changes. Thus, only the current law on education, in force from 2011, was amended 152 articles from 365, in other words, in a proportion of 41%³. Over these aspects, specific to Romania, it overlapped the requirements of adapting the education to the European requirements, by implementing the Bologna process. These problems specific to the domain overlapped the economic difficulties specific to the transition period to the market economy. The issue of higher education is the subject of the present paper, in which we sought to establish a few specific aspects of the domain and the period, in this sense we have recourse to comparisons with the European Union or with other countries. This paper aims at capturing the fundamental changes recorded in the current evolution of the Romanian population and also foreshadowing of weather. The decreasing of the population in our country is a very worrying phenomenon, and that is why we believe that the topic is of interest to both academic debate and also for the country; thus is for implementing executive some emergency measures to stop this phenomenon that punctuate effects on future generations. It is true that a slowdown in population growth is registered in the entire European continent, but what is registered in Romania is much worse, even compared only with the eastern continent. In this approach we intend to study some initial traits of evolution population in Europe, detect a number of negative traits and subsequently fit the evolution of Romania's population, thus framing Romania following European evolution. An aging population is another major phenomenon, with Romania registering more than 210,000 people over 65 than young people under 14 years. This situation is due to a part of a policy of ultra-restrictive and contrary to human dignity from the communist period and the changes in rural life since 1989. In order to tackle these issues we used some quantitative and qualitative methods, with the tools like: statistics, graphics and mathematics order are necessary in the measurable results, and in the development of predictions. There have been numerous debates on a new territorial organization of Romania during 2013 and 2014. The miracle of Romania regionalization was deemed to have contradictory effects from territorial construction to dissolution. Due to the presidential elections from the end of 2014, the process of regionalization was postponed, but some questions are still very alive: It is necessary to regroup counties into regions? The low development of Romania regions is caused by the lack of administrative decentralization? In Romania, territorial reform is synonym with institutional reform? Therefore, I consider that it is important to identify the potential sources of change in Romanian regional policy. The political debates on Romanian regionalization were mainly focus on political interests, without taking into account an important serious of factors that can spur growth and socio-economic development across our regions. Through this paper I try to investigate the specialised literature in order to identify some useful policy suggestions from regional scientists, which would be proper for Romania regional development, in the current context of Europe 2020 strategy. The Internet and e-business adoption are the most important issues of this century for travel agencies. At the same time, e-Small and Medium Tourism Businesses do not receive the recognition they deserve in a world where success is mandatory. This is a strange fact, if one considers that 70% of the world business is represented by small and medium tourism businesses owned by visionary persons who take advantages of acting at a small scale and help create a more dynamic economy. With the current rapid transformation of markets, the first element which influences the strategy of the economic activity of travel agencies is the character of the innovation. In order to learn the current business processes and the requirements of travel agencies, interviews and questionnaires will he conducted, business processes will be observed and existing reports, forms and procedures will be reviewed. Competitive strength of Romanian Small and Medium-sized Tourism Enterprises (SMTEs) lies in competitive advantages and distinctive competencies that we possess in relation to other competitors. The paper deals with the regional educational disparities across the EU, with a special focus on the Romanian NUTS 1 and 2 regions. The comparative analysis allows quantifying the Romanian regions position in the EU regarding education, using three indicators: population in all levels of education, students in tertiary education and leavers from educational and training. Forecasting procedures are used in order to describe the indicators' trend until 2020. Regression allows quantifying the regional disparities between European and Romanian regions related to the above three indicators. The main conclusion of the analysis is that the great Romanian educational dysfunctions are the result of an inefficient educational management at macro and regional levels. In this paper we analyze whether the Romanian economic context confirms the Armey model, and present the relationship between public spending and economic growth that may offer a suitable basis for decision makers. The analysis is based on quarterly data regarding public spending and economic growth in Romania. The analytic results did not confirm the premises related to the Armey Curve for the Romanian context during 1990-2011. The time interval is marked by unpredictable phenomena such as the transition from the state economy to the market economy and the world financial crisis, both of which alter the results. Banking Union is very important for financial stability of EU, for preventing any future crisis, for improving corporate governance in the banking sector, for completing the single market for financial services and for the strengthening of monetary union, for opening the way to fiscal union and to political union. There is not enough theoretical research in the field of banking union, but there are many recent contributions on behalf of foreign and Romanian experts and analysts, which refer mainly to the three components/pillars of EU banking union: a Single Supervision Mechanism (SSM), a Single Resolution Mechanism (SRM) and an harmonized system of deposit guarantee schemes. Some micro studies and surveys carried out by prestigious institutions, like Deutsche Bank, Brookings Institution, CEPS have been run over and analyzed together with the positions and opinions of different European officials, and also with the content of EU secondary legislation. An empirical research was made with the aim to identify all essential aspects relating to EU banking union, which may concern the academics, researchers and business community. When we speak of human rights and fundamental freedoms essential to the existence of individuals, the first thing that comes into mind is "what we must do more to protect these rights?", "What to do to for our freedoms not be violated?". For this reason the mere mention of the phrase "the restriction of certain rights and freedoms" makes us rebel against this idea and wonder if it is legally possible that such an event may happen. Thus, in this paper we propose to analyze the possibility and legality of restricting certain fundamental rights and specific conditions in which this restriction can be achieved according to the provisions in the Constitution of Romania.
